Terms & Conditions
These Terms & Conditions govern your stay at StayCosita properties. Please read them carefully before making a reservation or checking in.
1. Eligibility & Guest Verification
1.1 Minimum Age Requirement
Every guest staying at the property must be 18 years of age or older. Minors are not permitted to check in or stay at the property unless specifically permitted by applicable law and accompanied by a parent, legal guardian, or a written authorisation acceptable to the host.
This policy is implemented in accordance with the host's safety and security requirements and is subject to applicable laws, local police regulations relating to guest registration, and the legal capacity to enter into contracts under the Indian Majority Act, 1875, under which a person ordinarily attains the age of majority upon completing 18 years of age (Section 3).
The host reserves the right to refuse accommodation where the age or identity of a guest cannot be satisfactorily verified or where accommodation would be contrary to applicable law or directions issued by competent authorities.
1.2 Guest Identification
The reservation may be made by one individual on behalf of a group. However, every person staying at the property must complete the verification process and present a valid government-issued photo identification at the time of check-in.
The name on the identification document should match the details provided during the booking process whenever applicable.
1.3 Accepted Identity Documents
The following government-issued photo IDs are accepted:
- Aadhaar Card
- Passport
- Driving Licence
PAN Card is not accepted as a valid identity document for accommodation check-in.
1.4 Failure to Provide Identification
In accordance with applicable laws governing guest registration in India, including the Registration of Foreigners Act, 1939, the Foreigners Act, 1946, and directions issued by the local Police or other competent authorities, every guest must complete identity verification before occupying the accommodation.
The host reserves the right to refuse check-in to any guest who fails to provide a valid government-issued identification document or whose identity cannot be satisfactorily verified. Such refusal may result in cancellation of the reservation without refund, subject to Airbnb policies and applicable law.
Providing false, forged, altered, or misleading identification or knowingly furnishing false information may result in immediate cancellation of the reservation, refusal of accommodation, and reporting to the appropriate authorities. Such acts may also attract legal action under the Bharatiya Nyaya Sanhita, 2023, including offences relating to forgery of documents, using forged documents as genuine, and cheating or personation, wherever applicable, in addition to any action permitted under other applicable laws.
2. Reservation & Occupancy
2.1 Accurate Booking Information
Guests are required to accurately declare the total number of occupants while making the reservation.
2.2 Registered Guests Only
Only guests whose names have been declared and approved as part of the reservation are permitted to stay overnight at the property.
Visitors who are not included in the reservation may only enter the property with prior approval from the host and may be subject to additional charges or restrictions.
2.3 Additional Guests
The host reserves the right to deny entry to any undeclared guest.
Where permitted, additional guests may be accommodated only after:
- Prior approval by the host.
- Completion of identity verification.
- Payment of applicable additional guest charges.
2.4 Responsibility of the Booking Holder
The primary guest who made the reservation is fully responsible for the conduct of all accompanying guests.
Any breach of these Terms & Conditions or House Rules by any member of the group shall be considered a breach by the reservation holder.
3. Check-in & Check-out

3.3 Early Check-in & Late Check-out
Early check-in and late check-out are strictly subject to:
- Availability of the property.
- Prior written approval from the host.
- Payment of applicable additional charges.
The host cannot guarantee these requests and reserves the right to decline them depending on operational requirements.
3.4 Departure Responsibilities
Guests are expected to vacate the property by the scheduled check-out time to allow sufficient time for cleaning and preparation for incoming guests.
Before leaving, guests are requested to:
- Switch off lights, fans, air-conditioners, geysers, televisions, and all electrical appliances.
- Close and lock all doors and windows.
- Return all keys, access cards, remotes, or other access devices.
- Dispose of personal belongings.
- Leave the property in a reasonably clean and tidy condition.
Failure to return access devices may result in replacement charges.
3.5 Guest Satisfaction & Alternative Accommodation
If, immediately upon check-in, a guest believes that the allocated accommodation is unsuitable due to a genuine operational issue, the guest must notify the host without unreasonable delay. Subject to availability, the host may, at its sole discretion, offer an alternative room or accommodation of a similar standard. Provision of an alternative accommodation shall constitute a reasonable resolution where available. Refunds shall not be provided solely because a guest prefers another room, layout, location, view, décor, or accommodation option after check-in. If no alternative accommodation is available, the host shall resolve the issue in accordance with applicable law and Airbnb policies.
3.6 Payment Policy
Unless the reservation has already been prepaid through Airbnb or another authorized booking platform, the entire accommodation charges, including any applicable taxes, fees, security deposits, and approved additional guest charges, must be paid in full at the time of check-in. Payments after check-out or deferred payments are not permitted. The host reserves the right to refuse check-in until all outstanding amounts have been cleared.
3.7 Mandatory Identity Verification
Accommodation shall be provided only after completion of identity verification for every guest staying at the property. Guests who fail or refuse to provide valid government-issued identification, or whose identity cannot be verified in accordance with applicable laws, shall not be permitted to check in or occupy the property. Where check-in is refused due to failure to provide valid identification, the reservation may be treated as a guest cancellation, and no refund shall be payable, subject to Airbnb policies and applicable law.
3.8 Guest Belongings
Guests remain solely responsible for the safety and security of their personal belongings throughout their stay. The host shall not be responsible for the loss, theft, damage, destruction, or misplacement of luggage, cash, jewellery, travel documents, passports, electronic devices, vehicles, or any other personal property, except to the extent that such liability cannot be excluded under applicable law, including the Consumer Protection Act, 2019.
Guests are strongly encouraged to keep valuables secured at all times, ensure that doors and windows are locked whenever leaving the room, and promptly report any suspected loss, theft, or security incident to the host and, where appropriate, to the local Police. Nothing in this clause shall limit or exclude any liability that cannot legally be excluded under the laws of India. These provisions shall be interpreted in accordance with the Consumer Protection Act, 2019, the Indian Contract Act, 1872, and other applicable Central and State laws.
3.9 Purpose of Stay
Accommodation is provided solely for lawful residential and short-term lodging purposes. Guests shall accurately disclose the purpose of their stay if requested during check-in.
The property shall not be used for:
- Commercial activities without written approval.
- Filming or photography for commercial purposes.
- Parties or social events.
- Illegal activities.
- Gambling.
- Prostitution or immoral activities prohibited by law.
- Storage of prohibited or hazardous materials.
4. Cancellation Policy
Guest Cancellation
Reservations cancelled more than 24 hours before the scheduled check-in time shall be eligible for a full refund, subject to the cancellation policy applicable to the booking platform. Reservations cancelled within 24 hours of the scheduled check-in time, or after check-in, shall not be eligible for any refund. Failure to arrive (“No Show”) shall be treated as a cancellation after the permitted cancellation period, and no refund shall be payable.
5. Host Cancellation
In exceptional circumstances beyond the reasonable control of the host, including but not limited to:
- Natural disasters.
- Flooding.
- Fire.
- Earthquakes.
- Government restrictions.
- Public health emergencies.
- Civil unrest.
- Structural safety concerns.
- Utility failures rendering the property uninhabitable.
- Orders issued by any Court, Government, Municipal Authority, Police, Fire Department, or any other competent authority.
- Any other event constituting a force majeure event under applicable law.
the host reserves the right to cancel the reservation.
Where reasonably practicable, the host may, at its sole discretion:
- Offer alternative accommodation of a comparable standard, subject to availability; or
- Process a refund in accordance with Airbnb's applicable policies and the requirements of applicable law.
The host shall not be liable for any indirect, incidental, consequential, or special losses or damages, including but not limited to transportation expenses, missed flights or trains, loss of business, loss of income, loss of opportunity, accommodation booked elsewhere, or any other consequential damages arising from such cancellation, except where liability cannot be excluded under applicable law. This clause shall be interpreted in accordance with the Indian Contract Act, 1872, including the legal principles relating to force majeure and frustration of contracts under Section 56, the Disaster Management Act, 2005, the Consumer Protection Act, 2019, and any applicable Central or State Government laws, regulations, notifications, or orders.
6. Compliance with Laws
Guests shall comply with all applicable laws, regulations, government notifications, and local authority requirements during their stay. The property operates in accordance with applicable Indian laws governing hospitality establishments, including requirements relating to guest registration, identity verification, maintenance of guest records, and reporting obligations imposed by competent authorities. The host reserves the right to deny accommodation or terminate the stay where required to comply with any law, court order, police direction, or governmental instruction.
7. Prohibited Articles
Guests shall not bring, possess, use, store, or permit within the property any of the following:
- Illegal drugs, narcotic drugs, psychotropic substances, or controlled substances prohibited under the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act).
- Explosives, explosive substances, fireworks, or explosive materials except where lawfully authorized under the Explosives Act, 1884 and the Explosive Substances Act, 1908.
- Firearms, ammunition, or prohibited weapons without a valid licence or lawful authority, in accordance with the Arms Act, 1959 and the rules made thereunder.
- Hazardous, toxic, radioactive, corrosive, or dangerous chemicals or materials capable of endangering life or property.
- Highly flammable substances, fuels, gases, or materials likely to create a fire or explosion hazard.
- Stolen property or property reasonably suspected to be stolen.
- Any counterfeit, illegal, or prohibited article, or any item the possession, use, or storage of which is prohibited under the Bharatiya Nyaya Sanhita, 2023, the Information Technology Act, 2000 (where applicable), or any other applicable Central or State law.
The host reserves the right to refuse accommodation, terminate the stay without refund (subject to Airbnb policies and applicable law), confiscate or isolate prohibited items where legally permissible, and immediately report any prohibited or suspicious article to the local Police or any other competent authority, where required or permitted by law. Guests shall be solely responsible for any civil, criminal, or regulatory consequences arising from the possession or use of prohibited articles within the property.
8. Right to Refuse Accommodation
The host reserves the right to refuse accommodation or terminate an existing stay where:
- Required identity documents are not produced.
- The guest provides false or misleading information.
- Occupancy limits are exceeded.
- The booking has been obtained fraudulently.
- The guest poses a safety or security risk.
- Applicable laws or government regulations require refusal of accommodation.
9. Foreign Nationals (C-Form Compliance)
In accordance with the Foreigners Act, 1946, the Registration of Foreigners Act, 1939, the Registration of Foreigners Rules, 1992, and the directions issued by the Bureau of Immigration, Government of India, every foreign national staying at the property shall provide the following at the time of check-in:
- A valid Passport.
- A valid Visa or other lawful entry permit.
- Details regarding the purpose of the visit.
- Expected duration of stay.
- Residential address in India, where applicable.
- Country of residence and nationality.
- Any other information or documents required for the submission of the statutory Form C (C-Form) or any replacement form prescribed by the Government of India.
The host is legally required to maintain and submit the prescribed particulars of foreign guests through the Form C (C-Form) system within the time prescribed under the Registration of Foreigners Rules, 1992, and guests shall fully cooperate in complying with these statutory requirements. Failure to provide the required documents, information, or cooperation necessary for statutory compliance may result in refusal of accommodation or immediate termination of the stay, without liability on the part of the host and subject to Airbnb policies and applicable law. The host may also report such non-compliance to the appropriate authorities where required by law.
10. Smoking & Alcohol Policy
Smoking Policy
Smoking is strictly prohibited throughout the property. This prohibition includes, but is not limited to:
- Guest rooms
- Reception
- Lobby
- Corridors
- Staircases
- Elevators
- Parking areas
- Rooftops (where applicable)
- Shared balconies
- Common washrooms
- Any other indoor or outdoor area within the premises
For the purposes of this policy, “smoking” includes the use of cigarettes, cigars, bidis, pipes, e-cigarettes, vaping devices, hookahs, or any other smoking or tobacco-related products. Guests shall not engage in any activity that may:
- Damage furniture, mattresses, linen, curtains, carpets, walls, ceilings, flooring, fixtures, fittings, or décor.
- Trigger smoke detectors or fire alarm systems.
- Create excessive smoke or odours requiring specialized cleaning.
- Cause inconvenience, discomfort, or health risks to other guests or staff.
- Create a fire hazard or compromise the safety of the property.
Any evidence of smoking, including cigarette or cigar ash, burn marks, stains, smoke damage, deodorization treatment, or additional cleaning required as a result of a breach of this policy, shall be charged to the responsible guest. Smoking in prohibited areas may also constitute a violation of applicable public health laws, including the Cigarettes and Other Tobacco Products Act, 2003 (COTPA) and any applicable State or local regulations. Violation of this policy may result in additional cleaning or damage charges, immediate termination of the stay without refund (subject to Airbnb policies and applicable law), and any further action permitted under applicable law.
Alcohol Policy
Consumption of alcohol is permitted within the property. Guests are expected to consume alcohol responsibly and maintain respectful behaviour at all times. Alcohol consumption must not result in:
- Excessive noise.
- Disturbance to neighbours or other guests.
- Damage to the property.
- Aggressive, abusive, or inappropriate behaviour.
- Illegal activities.
- Unsafe conduct.
- Public nuisance.
The host reserves the right to request guests to leave the property immediately if their behaviour becomes disruptive, threatening, or unsafe. Any damages, breakages, cleaning expenses, penalties, or legal consequences arising from irresponsible alcohol consumption shall be the sole responsibility of the guest.
11. Property Care, Damage & Wear and Tear
Guests are expected to treat the property, furniture, appliances, décor, fixtures, and all provided amenities with reasonable care throughout their stay.
Normal and unavoidable wear resulting from ordinary use is understood and accepted by the host. Examples of normal wear and tear include minor fading of fabrics, slight scuff marks from everyday use, and natural ageing of furniture and fixtures.
However, wear and tear does not include damage caused by negligence, misuse, carelessness, accidents, or intentional acts.
Guests will be held financially responsible for, including but not limited to:
- Broken furniture.
- Damaged mattresses.
- Burn marks from cigarettes or other smoking materials.
- Stained linen, towels, bedding, or upholstery beyond normal laundering.
- Broken mirrors or glass.
- Damaged electronic appliances.
- Damaged doors, locks, windows, or walls.
- Missing keys, remotes, access cards, or other property.
- Plumbing blockages caused by improper disposal of waste.
- Damage resulting from parties or unauthorised gatherings.
- Pet-related damage where pets are not permitted.
- Excessive cleaning required due to misuse of the property.
The host reserves the right to recover the reasonable cost of repair, replacement, restoration, or additional cleaning through Airbnb's Resolution Centre or any other applicable method permitted under Airbnb policies. Guests are encouraged to report any accidental damage immediately during their stay. Prompt reporting allows the host to address the issue efficiently and may help avoid additional costs or complications. Failure to report damage before check-out may result in claims being submitted after inspection of the property.
By confirming the reservation and checking into the property, guests acknowledge that they have read, understood, and agreed to comply with these Terms & Conditions and all applicable House Rules throughout their stay.
12. Housekeeping & Cleanliness
Guests are expected to maintain reasonable cleanliness throughout their stay and use the property responsibly.
Housekeeping services, where applicable, shall be provided according to the property's schedule. Additional housekeeping requests may be available upon request and may attract additional charges.
Guests are requested not to dispose of food waste, sanitary products, cooking oil, diapers, wipes, or other inappropriate materials in sinks, washbasins, or toilets, as this may cause blockages and damage to the plumbing system. Any repair costs arising from misuse may be recovered from the responsible guest.
Guests are also requested to dispose of garbage only in the designated bins provided at the property.
13. Noise, Conduct & Respect for Others
The property is intended to provide a comfortable and peaceful environment for all guests and neighbours. Guests are expected to behave respectfully and avoid any activity that may disturb others.
The following activities are strictly prohibited:
- Excessive noise, shouting, or loud music.
- Parties or events without prior written approval.
- Disorderly, abusive, threatening, or violent behaviour.
- Illegal, immoral, or hazardous activities.
- Creating nuisance in common areas.
Guests may be requested to reduce noise levels immediately. Continued violation may result in immediate termination of the stay without refund.
14. Visitors Policy
For the safety and security of all occupants, only registered guests are permitted to stay overnight.
Visitors are permitted only with prior approval from the host and may be required to provide valid government-issued identification before entering the premises.
The host reserves the right to refuse entry to any visitor without assigning any reason where necessary for security or operational purposes.
Visitors are not permitted to use the property for gatherings, celebrations, commercial activities, or overnight stays unless expressly approved.
15. Security & Safety
Guests are solely responsible for safeguarding their personal belongings throughout their stay. The host shall not be liable for the loss, theft, damage, or misplacement of cash, jewellery, electronic devices, vehicles, luggage, travel documents, or any other personal property, except where such liability cannot be excluded under applicable law.
Guests are advised to keep valuables secure at all times and ensure that all doors, windows, and other access points are properly locked whenever leaving the room or property.
For the safety and security of guests, staff, and the property, CCTV surveillance may be installed and operated in common areas, including entrances, reception, corridors, parking areas, and other public spaces. No CCTV cameras or surveillance devices are installed inside guest rooms, bathrooms, or any other private areas. CCTV recordings may be preserved, accessed, and shared with law enforcement agencies or other competent authorities where required by law, for the investigation of criminal offences, security incidents, or legal proceedings.
Tampering with, obstructing, damaging, disabling, or interfering with CCTV systems, fire safety equipment, emergency exits, smoke detectors, alarms, or any other security or life-safety equipment is strictly prohibited.
Guests shall comply with all applicable laws relating to safety, public order, and security, including the Bharatiya Nyaya Sanhita, 2023, the Information Technology Act, 2000 (where applicable), and any directions issued by the local Police, Fire Department, Municipal Authorities, or other competent authorities. Any unlawful act or intentional interference with safety or security systems may result in immediate termination of the stay, recovery of damages, and reporting to the appropriate authorities.
16. Lost & Found
Any belongings left behind after check-out will be retained for a reasonable period, subject to available storage space.
The host will make reasonable efforts to contact the guest; however, the host shall not be responsible for unclaimed items.
If requested, lost items may be shipped to the guest at their own cost and risk.
Perishable items, food products, and low-value consumables may be discarded immediately.
17. Maintenance & Emergency Access
The host reserves the right to enter the accommodation, after reasonable notice wherever practicable, for maintenance, repairs, inspections, housekeeping, emergencies, or situations involving guest safety.
In the event of an emergency, the host may access the property without prior notice.
Guests are requested to promptly report any maintenance issue so that it can be resolved as quickly as possible.
18. Liability
Guests occupy and use the property, its facilities, amenities, and common areas at their own risk and are expected to exercise reasonable care for their own safety and the safety of others.
To the fullest extent permitted by applicable law, the host shall not be liable for any injury, accident, illness, death, loss, theft, delay, inconvenience, or damage to persons or property arising from circumstances beyond the host's reasonable control, including but not limited to:
- Power failures or electrical interruptions.
- Internet or telecommunications outages.
- Water supply interruptions.
- Mechanical or equipment failures.
- Natural disasters, including floods, earthquakes, storms, or other force majeure events.
- Government orders, restrictions, or emergency measures.
- Civil unrest, strikes, or acts of third parties.
- Any event that could not reasonably have been prevented by the host.
The host shall not be responsible for any indirect, incidental, consequential, special, or economic loss, including loss of business, profits, travel expenses, or missed connections, except where such liability cannot be excluded under applicable law. Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded under the laws of India, including the Consumer Protection Act, 2019, the Bharatiya Nyaya Sanhita, 2023, or any other applicable Central or State law. These Terms & Conditions shall be interpreted and enforced in accordance with the laws of India, and all guests agree to comply with applicable statutes, rules, regulations, and directions issued by competent governmental authorities during their stay.
19. Compliance with Laws
Guests shall comply with all applicable laws, regulations, government notifications, and local authority requirements during their stay. The property operates in accordance with applicable Indian laws governing hospitality establishments, including requirements relating to guest registration, identity verification, maintenance of guest records, and reporting obligations imposed by competent authorities. The host reserves the right to deny accommodation or terminate the stay where required to comply with any law, court order, police direction, or governmental instruction.
20. Prohibited Articles
Guests shall not bring or store within the property any:
- Illegal drugs or narcotic substances.
- Explosives.
- Firearms or ammunition without lawful authorization.
- Hazardous chemicals.
- Flammable materials likely to endanger life or property.
- Stolen property.
- Any item prohibited under applicable law.
Any prohibited item may be reported to the appropriate authorities where legally required.
21. Mandatory Guest Registration
As required under applicable law and directions issued by local police authorities, every guest shall provide valid identity proof and complete the prescribed guest registration process before occupying the accommodation. The host reserves the right to refuse accommodation to any guest who fails to comply with these legal requirements.
22. Identity Verification
Identity verification shall be carried out in accordance with applicable Government notifications and local police guidelines relating to guest registration. The host may retain copies of identity documents only to the extent permitted by law and solely for statutory compliance.
23. Fire & Safety Compliance
Guests shall comply with all fire safety instructions and shall not tamper with firefighting equipment, smoke detectors, emergency exits, or safety systems. Any act endangering life or property may attract liability under applicable provisions of the Bharatiya Nyaya Sanhita, 2023, in addition to civil liability for damages.
24. Reporting to Authorities
The host reserves the right to report any suspected illegal activity to the appropriate authorities, including the local Police, Foreigners Regional Registration Office (FRRO), Fire Department, Municipal Authorities, or any other competent authority, where required by law.
25. Government Orders
Guests shall comply with all government directions in force during their stay, including those relating to public health, disaster management, law and order, curfews, or emergency restrictions issued under the Disaster Management Act, 2005 or any other applicable law.
26. Acceptance of Terms
By making a reservation, completing the check-in process, making payment, or occupying the property, every guest confirms that they have read, understood, and voluntarily agreed to be bound by these Terms & Conditions, the House Rules, and all applicable laws, rules, regulations, and government directions in force during their stay.
Guests further acknowledge that these Terms & Conditions constitute a legally binding agreement between the guest and the host, to the extent permitted under applicable law.
Guests agree to comply with all applicable provisions of Indian law, including but not limited to the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Registration of Foreigners Act, 1939, the Foreigners Act, 1946, the Information Technology Act, 2000, the Cigarettes and Other Tobacco Products Act, 2003 (COTPA), the Disaster Management Act, 2005, the Bharatiya Nyaya Sanhita, 2023, and all applicable Central Government, State Government, Municipal, Police, Fire Safety, and local authority regulations, as amended from time to time.
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court or competent authority, the remaining provisions shall continue in full force and effect. The failure or delay of the host to enforce any provision of these Terms & Conditions shall not constitute a waiver of any rights or remedies available under applicable law.
The host reserves the right to amend, modify, or update these Terms & Conditions from time to time without prior notice to comply with changes in law, operational requirements, or property policies. The version in effect on the date of check-in shall govern the reservation and the guest's stay.
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts having jurisdiction over the location of the property shall have exclusive jurisdiction to resolve any dispute arising out of or relating to the guest's stay or these Terms & Conditions.
